Prices stated in an estimate may change if the scope of work changes, unforeseen site conditions are encountered, materials costs change materially before work begins, or if the customer requests changes after the contract is signed. Any change that affects the contract price will be documented in a written change order and requires the customer's approval before work proceeds.
Project start dates are estimates and are subject to weather conditions, permit processing times, material availability, and other factors outside our control. We will communicate schedule changes as soon as they are known.
If you need to cancel or postpone a scheduled project, please notify us in writing as soon as possible. Cancellation terms - including any deposit refund or retention policy - are specified in your written contract. In general, deposits paid to cover materials ordered specifically for your project may be non-refundable once those materials have been purchased.
We reserve the right to reschedule or postpone projects due to unsafe working conditions, including extreme heat, rain, or other weather that could compromise safety or work quality.
Payment terms are outlined in your written contract. A deposit is typically required to reserve your place on the schedule and to cover initial material costs. Progress payments may be required at defined milestones during construction. The final payment is due upon project completion, before the crew demobilizes from the site.
Accepted payment methods are stated in your contract. Balances not paid within the terms stated in the contract may accrue interest and may result in a mechanic's lien being filed against the property in accordance with California law.
Where required by applicable law and as agreed in your written contract, Riverbank Deck & Fence will obtain the necessary building permits before work begins. Permit fees are either included in the contract price or itemized separately. The customer is responsible for ensuring that any homeowners association requirements or other private deed restrictions that govern the property are communicated to us before the contract is executed.
Riverbank Deck & Fence warrants that all work performed will be completed in a workmanlike manner and in material compliance with applicable building codes and the specifications in the written contract. The specific warranty period and terms are stated in your written contract.
Manufacturer warranties on materials - such as composite decking boards, hardware, and coatings - are separate from our labor warranty and are governed by the respective manufacturer's terms. We will provide you with applicable manufacturer warranty documentation upon project completion.
Our warranty does not cover damage resulting from misuse, alterations made by others, acts of nature, or failure to follow recommended maintenance guidelines for the materials installed.
To the maximum extent permitted by applicable law, Riverbank Deck & Fence's total liability to you for any claim arising out of or related to the services provided or the use of this Site shall not exceed the total amount paid by you for the specific project giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of profit, or loss of data, even if we have been advised of the possibility of such damages.
